Tim Gillibrand has been practicing insurance litigation since 2012. He has dealt extensively with property-related claims, including subrogation, product liability, and negligence matters. He has conducted numerous Small Claims Court trials pursuing recovery on behalf of insurers and regularly represents clients before the Superior Court of Justice. Tim is a member of the National Association of Subrogation Professionals.
Tim has been trusted by clients to investigate and opine on insurance coverage, fraud, misrepresentation, and emerging issues in the insurance industry, including the legal impact of Uber usage in property claims. He has successfully defended an insurer at trial in a property coverage matter, obtaining a dismissal on the basis of the insured’s misrepresentation.
Tim regularly investigates coverage, priority of insurers, and accident benefits entitlement (including WSIB coverage) by way of Examinations under Oath. He has conducted numerous private arbitrations with respect to priority and has acted as co-counsel on a high level priority matter before the Ontario Court of Appeal.
Finally, Tim represents insurers in litigation involving tort / bodily injury and in accident benefits claims. He has successfully represented insurers in numerous hearings before the Licence Appeal Tribunal (LAT) and the Workplace Safety and Insurance Appeals Tribunal (WSIAT).
