Kathleen was called to the bar in 2009. Over the years, she has developed an insurance defence practice with a particular focus on fraud.
She handles all manner of fraudulent claims, including staged accidents, alleged passenger claims, fraudulent employment claims and fraudulent attendant care claims. She has conducted numerous Examinations under Oath and has worked closely with clients, engineers and investigators in defending and prosecuting fraudulent claims.
Kathleen’s practice areas also include bodily injury, occupiers liability and accident benefits work. While practicing in accident benefits, Kathleen has worked extensively on priority, loss transfer and WSIB files. She regularly handles complex accident benefits claims involving disputes over catastrophic impairment. She has appeared on behalf of clients before the Ontario Superior Court of Justice, FSCO, the W.S.I.A.T., the Licence Appeal Tribunal and in private arbitrations. Kathleen has conducted summary judgment motions before the Ontario Superior Court of Justice, Small Claims Court trials, FSCO arbitrations, LAT arbitrations and private arbitrations.
Kathleen frequently conducts Examinations under Oath delving into the issues of fraud, priority, loss transfer, WSIB entitlement and SABS exclusions.
